The goal of the Rescuing Recess Volunteer Challenge (the "Challenge") is to provide resource support to Public elementary schools across the United States and to encourage local volunteerism at the schools in an effort to raise one million (1,000,000) volunteer hours in support of recess and physical activity. The Challenge is governed by U.S law and subject to all applicable federal, state and local laws and regulations. Void wherever prohibited or restricted by law. By participating in the Challenge, participants agree to be bound by and accept all terms of these Official Rules.
1. ELIGIBILITY: The Challenge is a game of skill open to all "Public" elementary schools located within the 50 United States and the District of Columbia ("DC"). For purposes of these Official Rules, "Public" shall mean those schools that are provided for the public, recognized by their state’s department of education as of August 9, 2007, and whose curriculum, funding, teaching, and other policies are set through local government or school boards.
2. REGISTRATION: Beginning August 9, 2007, "Representatives" (defined below) of qualifying schools must log on to the Rescuing Recess website, located at www.RescuingRecess.com (the "Site") and provide the requested information to complete the Challenge registration on behalf of their school. A "Representative" may be a parent, teacher, teacher’s aid, principal or other person employed by or affiliated with the qualifying school, age eighteen (18) years or older, who agrees to coordinate with the school and act as a representative for the school during the Challenge Period. Schools may register at anytime, however, only those volunteer hours that take place after the school has been registered will be eligible. Each school may only register once. Participants attempting to register a school that has already been registered should contact the principal or an administrator at their school for more information. Cartoon Network reserves the right to re-select an individual to serve as a school’s Representative, in Cartoon Network’s sole discretion. Upon proper completion and submission of registration on the Site—and while supplies last--Cartoon Network will automatically send (1) Rescuing Recess ‘Recess Kit’ (a forty dollar ($40) value) to the registered school. The Recess Kit includes: one (1) Sports4Kids Recess Monitor Training DVD, one (1) Corporation for National & Community Service ‘Service Learning’ DVD, one (1) 16" red Rescuing Recess ball, one (1) 8.5" red Rescuing Recess ball, one (1) standard Rescuing Recess flying disc, one (1) 20-piece bucket of sidewalk chalk, one (1) 3-piece set of juggling scarves and one (1) 8" Chinese jump rope set.
3. HOW TO PARTICIPATE: Beginning August 9, 2007 through and including June 8, 2008 (the "Challenge Period"), each registered school must document and track the qualifying volunteer help that the school receives during the Challenge Period. Anyone age five (5) years and older may volunteer at the school, provided that each volunteer must be documented on the volunteer tracking sheet (the "Tracking Sheet"), available on the Site. To be considered, the Tracking Sheet(s) must be legible, complete and include the volunteer’s name, address and telephone number, the date, time and description of the service(s) provided for the school and any other requested information. The Tracking Sheet(s) must be signed by the volunteer, maintained by the Representative and submitted to Cartoon Network upon request. The parent or legal guardian of any volunteer age twelve (12) and under must complete and sign the Tracking Sheet on behalf of their child. Only those volunteer hours that directly support the school’s physical activity programs and healthy lifestyle initiatives will be counted toward the school’s total number of volunteer hours received during the Challenge Period, at Cartoon Network’s sole discretion. Eligible hours includes time spent being a recess monitor, helping the physical education teacher, helping renovate or build a playground, bringing healthy after-recess snacks, helping organize a volunteer database, helping coordinate a community-wide recess rally or giving playground equipment. A student’s participation in eligible activities at their school during school hours is not eligible. Each school’s Representative will be responsible for maintaining the Tracking Sheets, aggregating the totals using the Volunteer Hours Reporting Summary tracking Log (the "Log") available on the Site, and logging total completed volunteer hours on the Site within the times specified in section 4 below. Participating schools may be subject to audit of their submissions. Representatives will be responsible for verifying all submissions and for completing any and all compliance forms at the request of Cartoon Network. False or deceptive registration, submissions or acts may render a school ineligible. Cartoon Network will not be responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incorrect, lost, late, misdirected, incomplete, garbled or delayed registration entries or computer transmissions or other errors or problems of any kind which may limit or affect a Representative’s or school’s ability to participate in the Challenge. Participating schools may be disqualified if their Representatives are unable to provide any and all required documentation, including without limitation, the Tracking Sheet(s) and the Log(s), within five (5) business days of Cartoon Network’s requests. In the event of sabotage, acts of God, terrorism, computer virus, mechanical, technical, or operational defect or error or other events or causes beyond Cartoon Network’s reasonable control, which corrupt the integrity, administration, security or proper operation of the Challenge, Cartoon Network reserves the right to cancel, modify or suspend the Challenge. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation.
4. HOW TO WIN: Representatives must tally
their school’s total documented volunteer hours throughout the
Challenge Period and submit those hours via the Site within the
dates and times specified below:
• To be eligible for the mid-year prize drawing,
Representatives must log on to the Site between February 4,
2008 and February 17, 2008, and submit their school’s total
volunteer hours documented between 8/9/07 and 2/3/08.
• To be eligible for the grand and ultimate
prize drawings, Representatives must log on to the Site
between June 9, 2008 and June 21, 2008, and submit their
school’s total volunteer hours documented between (2/4/08 -
6/8/08).
On or around March 15, 2008, an independent judging organization will aggregate the total number of documented volunteer hours submitted from schools eligible for the mid-year prize drawing, and identify fifty-one (51) potential mid-year prize winners (collectively, the “Mid-Year Prize Winners”), consisting of one (1) school from each state and one (1) from DC with the highest number of volunteer hours documented in their state or district. On or around July 31, 2008, an independent judging organization will aggregate the total number of documented volunteer hours submitted throughout the Challenge Period, from among all schools participating in the Challenge, and identify fifty-one (51) potential grand prize winners (collectively, the “Grand Prize Winners”), consisting of (one (1) school from each state and one (1) from DC with the highest total number of volunteer hours documented, and one (1) ultimate prize winner (the “Ultimate Prize Winner”) consisting of the school with the highest total number of documented volunteer hours from among all schools participating in the Challenge. (The Mid-Year Prize Winners, Grand Prize Winners and the Ultimate Prize Winner are sometimes collectively referred to as the “Winners”). The odds of winning will depend on the number of schools participating and the number of volunteer hours documented. In the event of a tie, the Winner(s) will be determined by random drawing from among the tied schools. MANY WILL ENTER; FEW WILL WIN. The Challenge will be administered by SJI, Inc (“SJI”) and the decisions of Cartoon Network and SJI, in all matters regarding the Challenge are final and binding. Any state or district that fails to meet the eligibility and entry requirements and to submit volunteer hours shall be disqualified and the prize for that state or district shall be forfeited, in Cartoon Network’s sole discretion. Winners should receive their prize(s) within six (6) to eight (8) weeks of receipt of Winners Documents (defined below).
5. PRIZES: One (1) Ultimate Prize Winner will receive a Twenty-Five Thousand Dollar ($25,000.00) grant to be used toward supporting the school’s physical activity programs and healthy lifestyles initiatives, and may have the opportunity for their school to be the site of the 2008 Cartoon Network Recess Rally to kick off National Recess Week. Fifty-One (51) Grand Prize Winners will each receive a Two Thousand Five Hundred Dollar ($2,500.00) grant to be used toward supporting the school’s physical activity programs and healthy lifestyle initiatives. Fifty-One (51) Mid-Year Prize Winners will each receive one (1) gift certificate good for two hundred fifty dollar ($250.00) worth of merchandise from the Sportime, Inc. (“Sportime”) physical education catalog (“Gift Certificates”). The Gift Certificates are subject to the terms and conditions accompanying them (if any) or as may be provide by Sportime. TOTAL AMV OF ALL PRIZES (103 PRIZES) One Hundred Sixty-Five Thousand Two Hundred Fifty Dollars ($165,250.00). Prizes must be issued in the name of the school and prizes will be sent directly to the school. No substitution or transfer of prize(s) or cash redemptions permitted by Winners. Cartoon Network reserves the right to substitute any prize (s) of like value for any reason whatsoever, at its sole discretion. Winning schools will be responsible for the reporting and payment of all federal, state and local taxes (if any).
6. GENERAL RULES AND REGULATIONS: By participating in this Challenge, participants grant Cartoon Network and its designees the right, unless prohibited by law, to use their names, voices, pictures, likenesses, and any submissions they may provide, in whole or in part, without compensation, notification or permission for the purpose of advertising, retail, sale, and publicizing the goods and services of Cartoon Network and all matters related to the Challenge, in any manner or medium, now or hereafter known, throughout the world in perpetuity. Participants must execute any documents necessary to perfect such rights in Cartoon Network and its designees. The principle, authorized school representative, or official of the winning schools may be required to sign eligibility, prize and/or tax acknowledgment form(s), compliance form(s), liability releases, or other release forms as otherwise reasonably requested (collectively “Winner Documents”) and return within five (5) business days of issuance of notification. If (i) any prize notification is returned as undeliverable, (ii) a winning school declines its prize, (iii) a winning school fails to provide copies of all documentation requested by Cartoon Network within the time specified above, or (iv) a winning school fails to comply with any of the Official Rules as outlined herein, such Winner will be disqualified and an alternate potential winner will be notified at Cartoon Network’s sole discretion. Cartoon Network, SJI, Sportime, and all other partners associated with Rescuing Recess and Get Animated, and each of their subsidiaries, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies and affiliated entities, and each of their respective officers, directors, shareholders, agents and employees (collectively, the “Released Parties”) expressly disclaim any responsibility and participants agree to indemnify and hold harmless the Released Parties from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Challenge (regardless of the cause of such injury or loss), the delivery and/or subsequent use or misuse of any prize awarded.
7. PRIVACY NOTICE: Any personally identifiable information collected in connection with the Challenge will only be used by Cartoon Network and its agents in connection with the Challenge, and with participant’s consent, for mailing of occasional Rescuing Recess and Get Animated promotional materials from Cartoon Network. Additionally, Cartoon Network may disclose personally identifiable information to school officials or other third parties to enforce the Challenge rules, to protect Cartoon Network’s rights or property or to comply with law or requests by law enforcement agencies. Questions or concerns about this privacy notice and its implementation or requests to review, correct or delete personally identifiable information collected in connection with the Challenge should be directed in writing to Rescuing Recess Volunteer Challenge Privacy Manager, c/o Cartoon Network Legal Department, 1050 Techwood Drive NW, Atlanta, Georgia 30318. 8. DISPUTES: Except where prohibited, participants and their parents/legal guardians agree that any and all disputes, claims and causes of action arising out of or connected with the Challenge or any grant awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Fulton County, Georgia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or participants’ and/or Sponsors’ rights and obligations in connection with the Challenge shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.
